RS160725 – 6:01:43 Carlos Slay came forward to request that the Board have the County Attorney conduct a review of the settlement with the Tax Collector and adopt an Ordinance that would ban all elected public officials who hold an office in Nassau County from seeking contracts with local government or buying/selling anything of valued interest. Mr. Mullin responded that neither of the requests by Mr. Slay can be accomplished through this forum; perhaps there are other entities that Mr. Slay could approach, such as filing a complaint with the Public Ethics Commission or the State Attorney’s office. There is no basis in fact to pursue such complaints through the County Attorney’s office.

RS160725 – 6:09:02 (Tab B) Consider a Resolution relating to a parking restriction on both sides of Miner Road between Virginia Lane and 85386 Miner Road, providing findings by the Board of County Commissioners; providing for placement of “No Parking” signs; providing for penalties; and providing for an effective date.

Discussion: Mr. Herring reviewed the request and a brief discussion followed.

RS160725 – 6:14:52 (Tab_D) Set tentative millage rates and date/time of first public hearing for the Fiscal Year 16/17 budget; and authorize OMB to electronically submit the DR-420 forms.

Discussion: Ms. Jones reviewed the request. She also discussed a request from the City of Fernandina Beach to set a new millage rate of 0.1021 mils for the Amelia Island Beach Renourishment MSTU, identified as property on Amelia Island excluding the SAISSA MSBU. She proposes the other millage rates (Countywide, Municipal Service, and Drainage District) remain the same.

Request: Commissioner Leeper requested that the County Manager contact the City Manager to clarify the City’s desire for this assessment for this year.

Motion: Authorize OMB to electronically submit the DR-420
forms and schedule the first public hearing for Thursday, September 15, 2016 at 6:00 p.m. to consider the tentative Fiscal Year 16/17 Budget.

RS160725 – 6:18:45 (Tab E) Consider an Ordinance rescinding Ordinance Nos. 2014-002 and 2015-01 and adopting an Ordinance of the Board of County Commissioners of Nassau County, Florida, establishing rules and regulations, rates, fees and service charges to be imposed for the user of water and sewer services for the water and sewer system owned and operated by Nassau County; Providing for severability; Providing for repeal of inconsistent Ordinances; Providing for definitions; Providing an effective date.

Mr. Mullin read the legislative procedures.

Discussion: Mr. Herring reviewed the request.

Audience input: Steve Sherman came forward to question the automatic five percent increase in rates each year. Mr. Herring responded that based on the information provided the five percent increase is appropriate based on the cost experienced by utilities throughout Florida and the country.

Discussion: Andy Burnham, Burton and Associates, came forward at the request of Commissioner Spicer to reiterate the findings of the recent rate study. To address board members’ concerns, he commented that in order to meet the full financial requirements of the system there needs to be a larger increase in the wastewater side to meet the capital improvement requirements as identified for the utilities. The five percent increase in total is needed for a period of time to sustain the total capital reinvestment needs of the system. Every two or three years the cost of service distribution will be re-evaluated and make any adjustments as needed.

COUNTY MANAGER BUSINESS:
RS160725 – 6:33:13 Mr. Selby advised the Board that Peter King, Planning and Economic Opportunity Director, has submitted his resignation effective August 5, 2016. Mr. King thanked the Board for the opportunity to work with them and the County. Commissioners thanked Peter for his service to the community and wished him well.
