Public Records Section 119.07(1)(a), Florida Statute establishes a right of access to public records in plain and unequivocal terms: Every person who has custody of a public record shall permit the record to be inspected and examined by any person desiring to do so, at any reasonable time, under reasonable conditions, and under supervision by the custodian of the public record or the custodian's designee. The custodian shall furnish a copy or a certified copy of the record upon payment of the fee prescribed by law...and for all other copies, upon payment of the actual cost of duplication of the record. The Clerk of Courts is named in the Florida Constitution as the Custodian of Records. Florida Statutes chapter 119 covers thoroughly the citizens right to inspection and copies of public record. As your elected Clerk, I take your right to access your public records as a fundamental right, and my policy in order to comply with Florida Statutes and your rights is as follows and paraphrases Statute 119: Any person wishing to access any public records in the possession of myself or my employees, will be given access to those records for your inspection without delay at the location of the record. You are always welcomed in my office for personal inspection of records. If the record is stored at some other location, or under the control of another individual or department, I will use all available resources and influence to make those records available to you as rapidly as possible. If you are in need of printed copies, I will provide those as rapidly as possible using the available resources of my office, at the cost prescribed by statute.
